Welcome to DuetCut. The Service is operated by Affiliate Mechanic, doing business as DuetCut ("DuetCut", "we", "us"). By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. The service
DuetCut provides web-based tools for combining, editing, and rendering short-form video content (the "Service"). We may add, change, or remove features from time to time. We do not guarantee that the Service will be uninterrupted, error-free, or permanently available.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service, or the minimum age required in your country, whichever is higher. You agree to provide accurate information and keep it up to date.
3. Your content
You retain all rights to the video clips and other materials you upload ("Your Content"). You grant DuetCut a limited, worldwide, royalty-free license to host, process, and display Your Content solely to operate and improve the Service for you. You represent that you own or have all necessary rights to Your Content and that uploading and processing it does not infringe anyone else's rights.
4. Acceptable use and misuse
You must not misuse the Service. In particular, you may not:
- use the Service for any unlawful, fraudulent, or deceptive purpose, or to send spam;
- upload, generate, or distribute content that is illegal, infringing, defamatory, or sexually explicit involving minors;
- infringe any intellectual property, privacy, or other rights of any third party;
- interfere with or compromise the security or integrity of the Service, including by introducing malware, probing or scanning vulnerabilities, scraping, or circumventing access controls or rate limits;
- reverse engineer, resell, or redistribute the Service, or use it to build a competing product.
5. IP rights and takedown
Because the Service is used to combine and edit video, we take rights complaints seriously. If you believe content processed through the Service infringes your copyright or other rights, email abuse@duetcut.com with the URL or project ID, a description of the protected work, and a statement of your rights. We will review and remove infringing content where appropriate, and we may suspend or terminate accounts of repeat infringers.
6. Subscriptions, billing and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing frequency, taxes, cancellations, and refunds are governed by Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically until cancelled; you can cancel at any time from your account or by contacting us.
7. Intellectual property
The Service, including its software, design, and brand, is owned by Affiliate Mechanic (dba DuetCut) and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan. Nothing in these Terms transfers any of our intellectual property to you.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, DuetCut will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the twelve months preceding the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your license to use the Service ends and we may delete Your Content after a reasonable export window.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Affiliate Mechanic is established, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction, subject to any non-waivable consumer rights you may have.
12. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will give reasonable notice (e.g., by email or in-app notice) before they take effect.
